Terms of Use — REPS Hours

These Terms of Use ("Terms") govern your access to and use of the REPS Hours mobile application and website (collectively, the "Service") operated by REPS Hours ("we," "our," or "us"). By using the Service, you agree to these Terms in full.

1. Service Description

REPS Hours is a time tracking and documentation tool designed to help real estate professionals log, monitor, and export the hours required for IRS Real Estate Professional Status (REPS) qualification.

Important: REPS Hours is a tracking tool only. It does not provide tax, legal, or accounting advice. Consult a qualified CPA or tax professional for guidance on Real Estate Professional Status qualification, tax deductions, or IRS compliance.

2. Account Registration

To use REPS Hours, you must create an account using email/password, Google Sign-In, or Sign in with Apple. You are responsible for:

Providing accurate account information
Maintaining the security of your login credentials
All activity that occurs under your account

You must be at least 13 years old to create an account. By using the Service, you represent that you meet this requirement.

3. Subscription Terms

Free Plan

The free plan provides manual hour logging for one property, a progress dashboard, and CSV export. No payment is required.

Pro Plan

The Pro plan unlocks additional features including AI-powered logging, unlimited properties, PDF exports, file attachments, calendar sync, and custom categories. Pro subscriptions are available as monthly, annual, or lifetime purchases.

Billing

All subscriptions are processed through the Apple App Store or Google Play Store. Payment is charged to your app store account. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device's app store settings.

Free Trial

New users may be eligible for a free trial of the Pro plan. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan at the listed price.

Refunds

Refunds are handled by Apple or Google per their respective refund policies. We do not process refunds directly.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to our systems or other users' data
Reverse engineer, decompile, or disassemble the app
Upload malicious content, viruses, or harmful files
Use the Service to generate fraudulent tax documentation
Resell, sublicense, or redistribute the Service
Interfere with or disrupt the Service or its infrastructure

5. Your Content

You retain ownership of all data you enter into REPS Hours, including time entries, property information, notes, and file attachments ("Your Content"). By using the Service, you grant us a limited license to store, process, and display Your Content solely to provide the Service to you.

You are solely responsible for the accuracy of Your Content. We do not verify the accuracy of hours logged, property details, or any other information you enter.

6. Intellectual Property

The REPS Hours app, website, brand, logo, design, and underlying technology are owned by us and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding.

7. Third-Party Services

REPS Hours integrates with third-party services including Firebase, Google Drive, RevenueCat, and the Apple/Google app stores. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee that the data you log or export will satisfy IRS requirements or result in REPS qualification. Tax compliance is solely your responsibility.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REPS HOURS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, TAX PENALTIES, OR IRS AUDIT OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Account Termination

You may delete your account at any time from the app's Settings screen. Account deletion permanently removes all your data from our servers and cannot be undone.

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the Service. We will make reasonable efforts to notify you before termination except in cases of serious violations.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by updating the effective date at the top of this page. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
